Following an arrest for DUI, it is incumbent on the defendant to request a Department of Motor Vehicle (DMV) hearing within seven days of the citation. If no hearing is requested then the defendant’s right to drive can be revoked for a year or longer at that time, depending on prior convictions, or it can be revoked by the traffic following a determination by the hearing officer.
But a license can also be revoked in the court where the criminal case is tried, or subsequently by the DMV for points or habitual infractions.
