Following an arrest for DUI, it is incumbent on the defendant to request a Department of Motor Vehicle (DMV) hearing within seven days of the citation. If no hearing is requested then the defendant’s right to drive can be revoked for a year or longer at that time, depending on prior convictions, or it can be revoked by the traffic following a determination by the hearing officer.
But a license can also be revoked in the court where the criminal case is tried, or subsequently by the DMV for points or habitual infractions.

Face it, you shouldn’t get behind the wheel of a car when you’ve been drinking. But here’s a little reminder to be even more careful over holidays, when law enforcement cracks down even harder. Over the Halloween holiday almost 450 people were arrested in a statewide crackdown.
